2013 Company Terms and Policies

GENERAL:

For purposes of this agreement, the term "The Company" is meant to represent Titan Specialty Metals, LLC. 

This document supersedes all previous company terms and policies.

Titan Specialty Metals, LLC reserves the right to make changes to company terms and policies at any time, and without warning. Titan Specialty Metals, LLC also reserves the right to make changes and/or modifications in pricing structure or product design at any time, and without warning.

LABOR RATE:

Our current labor rate is $90.00 (Ninety U.S. Dollars) per hour.

PAYMENT:

All work requires a deposit of 50% down at the time of estimate, either verbal or written, before work will begin.

Any change(s), either verbal or written, nullifies any verbal or written estimates of both cost and time.

Upon completion of invoiced work, all invoices must be fully paid before the vehicle or product is permitted to leave our premises.

Titan Specialty Metals, LLC accepts the following as payment: Certified Checks, Money Orders, and Cash, as well as personal or company checks, which are subject to a $25 return check fee. Collection costs and any other associated costs will be paid by the customer if a check is returned for any reason. Credit Card payments may be considered but must be approved by the company prior to work being performed.
Titan Specialty Metals, LLC reserves the right to decline any form of accepted payment from any customer at any time, without cause or reason.

PAST DUE ACCOUNTS:

A penalty fee of 1.7% per 30-day period (or 20.4% annually) shall be applied to all past due accounts. Past due accounts are those invoices which are not paid in full within 30 days after completion of work. This penalty fee will accrue on the full balance due until paid in full. Storage fees will also apply to any vehicles left at our facility beyond one day  from the date of completion, unless arrangements are made with Titan Specialty Metals, LLC at or before the date of completion. Storage fees will total $50.00 (Fifty  U.S. Dollars) per day.

SALES AND RETURN POLICY:

ALL SALES ARE FINAL, NO RETURNS ACCEPTED

Used parts are sold as-is without any warranty of any kind, either expressed or implied. There is no guarantee made as to the condition of used parts, as many times their exact condition is unknown. Customer assumes all risks connected with the purchase, installation, and/or use of used parts sold by Titan Specialty Metals, LLC. The company will not be held liable for any delays or damages, consequential or otherwise, incurred as a result of the sale, installation, or use of used parts.

Customer-supplied parts will not be accepted unless prior approval from the c
company is acquired.

NOTICE OF LEGAL DISCLAIMER:

Any products (including motor vehicles) sold, modified, or installed by Titan Specialty Metals, LLC that are intended for high performance, racing, and off-road use will not be warrantied given the nature of such parts, the unusual stresses placed upon them, and the fact that we cannot control how they are used. Titan Specialty Metals, LLC expressly disclaims any warranty, either expressed or implied, including all warranties of merchantability or fitness for a particular purpose. Titan Specialty Metals, LLC also disclaims any other obligation or liability as a result of products sold and/or installed or any service provided. No representations have been or will be made to the buyer regarding Titan Specialty Metals, LLC products, including, but not limited to, their quality or performance. Titan Specialty Metals, LLC shall not be held liable for any damages caused by a defect or failure of parts manufactured, sold, installed, or services performed. The company shall not be responsible for any damages, consequential or otherwise, arising from any cause whatsoever. Titan Specialty Metals, LLC will not be responsible for labor, transportation, or any other related costs incurred as a result of any part failure or defect. If at any time Titan Specialty Metals, LLC requires the services of an attorney in reference to the customer or activities related to the customer, whether legal action is brought or not; the customer agrees to pay all costs involved, including, but not limited to, court costs and attorney fees.

The installation of any product sold by Titan Specialty Metals, LLC on any vehicle intended for use on public roads may violate certain U.S. and/or State laws or regulations, including those relating to motor vehicle safety and emissions standards. The purchaser assumes all risks and expenses relating to unlawful vehicle operation on public roads. Titan Specialty Metals, LLC shall not be held liable for unlawful vehicle operation.

Agreement to Hold Harmless

Titan Specialty Metals, LLC will not be held responsible for any damages to persons and/or property while vehicle/product  is located at our facility or while under the care or direction of authorized employees or agents of the company. Titan Specialty Metals, LLC along with its employees or agents, will not be held liable for damages, consequential or otherwise, to vehicles/products left at our facility or under our care and/or operation. It is the responsibility of the customer and/or vehicle owner to maintain adequate insurance coverage while the vehicle remains at our facility or under our care. Titan Specialty Metals, LLC is not responsible for acts of vandalism, theft, weather, fire, or any other reason that may cause damage to a customer vehicle. In the course of executing a work order, Titan Specialty Metals, LLC may be required to test drive customer vehicles. It is the responsibility of each customer to maintain valid and current State registration and inspection documentation for the vehicle when under the care of Titan Specialty Metals, LLC. Proof of such registration and inspection must be kept with the vehicle at all times, along with valid proof of adequate insurance coverage. The customer will be responsible for payment of any fines, fees, or legal costs incurred as a result of failure to maintain current insurance coverage, State registration, or vehicle inspections for the vehicle.

Waiver and Assumption of Risk

Each and every customer of Titan Specialty Metals, LLC voluntarily makes and grants this waiver and assumption of risk for itself and its assigns, in favor of the company for the opportunity to utilize the facilities, equipment, materials, and any other asset of the company; and/or to engage in activities or gatherings sponsored by the company; and/or to utilize the labor and materials supplied by Titan Specialty Metals, LLC for use in a motor vehicle. The customer will hereby waive and release any and all claims whether in contract or of personal injury, bodily injury, property damage, damages, losses, and/or death that may arise from aforementioned installation, use, or receipt. Customer understands and recognizes that there are certain risks, dangers, and perils connected with the installation and use of high performance, racing, and/or off-road parts. It is fully acknowledged that these risks are understood at the time of purchase.

All claims involving Titan Specialty Metals, LLC are to be governed by the laws of the State of Colorado.
